Business Skills Visa
Australia's Business Skills Migration Program encourages business people such as business owners, investors and senior executives to settle permanently in Australia. Successful businessmen and women contribute to the Australian economy by developing new or existing businesses in Australia, including:-
- Businesses wishing to carry out operations in Australia
- Potential business migrants seeking a State-Sponsored Visa
- Business people in Australia seeking foreign partners
Business migrants benefit Australia by:
- Developing international markets
- Transferring capital and making investments
- Introducing new or improved technology
- Substituting Australian-made products for goods that would otherwise be imported
- Exporting Australian goods and services
- Creating or maintaining employment
New two-stage arrangements introduced on 1st March 2003 mean that:-
- successful business migrants are first granted a Business Skills (Provisional) visa for four years, then
- after establishing the required level of business or investment, they are eligible to apply for a Business Skills (residence) Visa (permanent residence) in Australia.
Who can apply for a Business Skills Visa?
- Business Owner: for owners or part-owners of a business;
- Senior Executive: for senior executive employees of a major business;
- Investor: for investors and business people wishing to invest in Australia;
- Business Talent: for high-calibre business people who have State/Territory Government Sponsorship.

Business Sponsorship
An Australian or overseas business who wish to employ staff in Australia can sponsor prospective employees. They can provide sponsorship either for a temporary visa lasting up to 4 years, or for a permanent visa. There are significant concessions for positions in regional Australia.
State Sponsorship
An important component of the Business Visa (Permanent Residence) is the State Sponsored Visa. Application for this type of visa involves the sponsorship of an individual by one of the Australian states. This avenue can be much easier than other approaches, particularly if the individual is intending to live in regional Australia. We can assist in developing a business case for this class of visa.
The Business Skills Visa categories
(i) Business Talent (Migrant) Visa is for high calibre business people who are owners or part owners of an overseas business, with significant business assets. They must also be genuinely committed to take part as a principal in the management of a new or existing business. This category must involve sponsorship by State or Territory Government.
(ii) Business Skills (Provisional) Visa is valid for four years.
Business Owner (Provisional) is for people with a successful business career, including business owners and senior management with significant business assets. They must also be genuinely committed to take part as a principal in the management of a new or existing business. Applicants in this category may be sponsored by State or Territory Government.
Senior Executive (Provisional) is for senior executive employees of large overseas businesses. Applicants have usually been responsible for strategic policy development. They need to possess significant net assets and be genuinely committed to take part as a principal in the management of a new or existing business. Applicants in this category may be sponsored by State or Territory Government.
Investor (Provisional) is for investors and successful business people and investors with significant net assets. They must be willing to invest funds in a designated investment in Australia for four years. They also need to be genuinely committed to maintain business and investment activity in Australia. Applicants in this category may be sponsored by State or Territory Government.
(iii) Business Skills (Residence) Visa permits permanent stay in Australia with a resident return facility which is valid for five years from the date of grant.
Business Owner (Residence) is for people who hold a Business Skills (Provisional) Visa. They must have owned a business in Australia for at least 2 years, affording significant personal and business assets involving a minimum number of employees. Applicants must have been in Australia for at least one year in the two years immediately prior to applying. Applicants in this category may be sponsored by a State or Territory Government.
Investor (Residence) is for people who have held a Investor (Provisional) Visa and a designated investment for a minimum of 4 years and who have lived in Australia for at least 2 years in the four years immediately prior to the application. Applicants in this category may be sponsored by a State or Territory Government.
Once a person’s business has become established in Australia, Residence Visas are easy to obtain. The criteria for the Residence Visas are lower than they are for the Provisional visas. This is mainly due to the fact the Australian Government wishes to encourage enterprising and skilled business managers to remain in Australia.
